PROJECT DESCRIPTION
The Government of Kenya (GoK) wished to increase private sector participation (PSP) in the country’s infrastructure sectors. A key element in the successful implementation of PSP was determined to be the establishment of an appropriate regulatory and legal framework. In order to develop the framework, the World Bank funded this assignment to develop the framework for GoK to progressively start independent regulation of the transport and other selected utility sectors. This regulatory study was specifically designed to facilitate the on-going privatization of the railways and provide potential private investors with clear rules for regulating the sector.

S&E provided the Lead Economist and Energy Expert in this World Bank funded project to create an appropriate regulatory, legal, and institutional framework to support private sector participation initiatives across Kenya’s infrastructure sectors.
Our work focused principally on how regulatory policy in the energy sector may be amended to help facilitate private investment which entailed reviewing key policies with respect to tariff setting, performance monitoring, licensing and dispute resolution.
